PREAMBLE

Banzai Media S.R.L. is a company with the registered office placed in Via G. Battista Vico 42‚ 20123 Milano (AlterVista). It provides an advanced hosting service with different features, through its site named AlterVista at the address www.altervista.org ("Site").

SPECIAL ADVICE FOR CONSUMERS: If the user is a physical person which requires the service for unrelated purposes to his or her entrepreneurial or professional activity and is considered a "Consumer" according to the legislative decree n. 206 of 6.9.2005 ("Consumer Code"), he or she will be subject to the dispositions contained in the Consumer Code and to those generally applicable to the service provided by AlterVista according to the legislative decree n. 70 of 9.4.2003 on the services of the information society and the electronic commerce.

According to the articles 7 and 12 of the legislative decree n. 70 of 9.4.2003, AlterVista communicates to the users the following information: The services lender presented in the General Conditions is Banzai Media S.R.L., with the registered office placed in Via G. Battista Vico 42‚ 20123 Milano, Italy. VAT registration number: 05791120966.


1. Definitions

The succeeding terms imply the following specified meaning:
  • Service: The advanced hosting service provided by AlterVista, with the web space exclusively represented in relation with the creation of web spaces through a own platform.
  • Site: The website of AlterVista, available at the address www.altervista.org.
  • Hosted websites: the websites created by users and hosted in the Site by using the web space made available by AlterVista.
  • User: Every person who has successfully concluded the following described registration procedure, by accepting the current General Conditions and assuming the rights and the obligations here described.
  • General Conditions (Terms of Service): The contract terms and conditions accepted by the user at the end of the registration procedure, by clicking on the button "Accept"
  • Contract: The contract, subject to the General Conditions, which is concluded between AlterVista and every user.

The General Conditions will be applied also to the services which will be provided to the users in the future, unless differently specified during the registration procedure or during the first supply of the new service. Some services, in any case regulated by the General Conditions, may be subject also to particular terms and conditions, depending on their nature and/or their features, which will be communicated to the users with the modality provided by the General Conditions.


2. Service features

2.1 The service provided has the following features:
  • Endlessly expandable web space.
  • Php/mysql support.
  • Intuitive control panel for managing the hosted website.
  • No compulsory advertising.
  • The possibility to earn money by displaying advertisements that AlterVista makes available on the registered website (you receive 5.16 Euros as a starting bonus)
  • The possibility to increase your site's visibility by putting it on the AlterVista web directory.
  • A forum, blog, gallery or CMS at your disposal without the need to download, configure or install anything.

2.2 The service is freely supplied to the on line registered users according to the modalities contained in the following article 3 of the General Conditions.

2.3 The user has the right to allow AlterVista, also by e-mail, to publish the hosted website in the AlterVista home page or in some linked pages for statistical and editorial purposes or for peopling the web directory. The user assumes full responsibility for the content of the hosted website, according to the article 5 of the General Conditions.


3. Registration modality

3.1 The access to the service is allowed only to a registered user through a username (nickname) which represents also a part of his/her website's address (http://nickname.altervista.org) and a keyword (password). The user has the right to modify the password following the instructions in the site and he/she acknowledges that the nickname and the password represent the validation process of the user's accesses to the service and constitute the only proper way to legitimate the user to access the service. The user assumes therefore full responsibility for all the actions done by using his/her own nickname and password. The user must preserve the nickname and the password in the utmost secrecy and keep them with the maximum attention.

3.2 The user engages to promptly communicate to AlterVista in writing form by a recorded delivery mail letter or certified mail letter with receipt advice at the address Banzai Media S.R.L., Via G. Battista Vico 42‚ 20123 Milano, Italy or via mail at the address abuse@altervista.it (only if it is followed by the sending of a recorded delivery or certified mail letter with return within 48 hours) i) any use of the own web space with inappropriate use of his/her nickname and password, ii) any unauthorized use of his/her nickname and password, iii) any other security violation of the service or of the hosted site. AlterVista binds itself, after notification, to deactivate the password subject to secrecy violation.

3.3 During the registration procedure some personal data are required to the user. The treatment of these data is done based on the legislative decree n. 196 of 2003 (Privacy Code) and according to the user's information in the registration procedure. With the acceptance of the general conditions, the user declares that his/her data are updated, correct and truthful and he/she engages to promptly modify them to make them constantly updated, complete and truthful.


4. Use of the web space

4.1 The publication of pornographic, obscene and illegal material is not allowed: for example, pirate softwares, cracks, warez, malwares, viruses, phishing sites (login fake), mp3 which violate the rules on author's rights and material which can cause damages to others.
User is not allowed to publish material that is illegal, obscene or damaging to the reputation of others to a third party.

4.2 The registered user also declares to assume full legal responsibility for the contents published in the hosted site, excluding and without accusing AlterVista of any claim or demand due to the use or abuse of the offered services.

4.3 The user acknowledges that AlterVista has the right to access, in every moment, without any advice and at its discretion, the hosted sites to verify the observance of the General Conditions. AlterVista has the right to immediately suspend the service if it is convinced, according to its unquestionable judgement or under notification of others, of the violation of the General Conditions. The user acknowledges that AlterVista, in the fulfilment of its obligations derived from unbreakable legal rules, may give the material present in the hosted sites and/or reveal the content to the relevant authorities. AlterVista is specifically authorized to insert in the site every necessary attention about the nonexistence of some link between AlterVista and the User or the activity done by him or her through the hosted sites.

4.4 It is not allowed to use the account simply as a space to store downloadable files, dynamic elements or other material used by external websites, as well as create more accounts for a single hosted website (so-called "mirroring"), or host parts of this.

4.5 It is not allowed to abuse of the area restriction service through a password, by creating archives, databases or sites whose most relevant content is not freely accessible to public.

4.6 The bandwidth available to users for the http connection is not subject to any limitation, except some technological limitations imposed by the equipment. However to the hosted sites which use the service to allow the downloading of multimedia files, will be fixed a basic traffic limit of 10 monthly Gbyte (the limit is expandable to infinity according to the ways and procedures described in the FAQs and in the online help of the user control panel).

4.7 The free use of the own available resources also for the online setting of commercial sites is allowed. However in this case some changes to the rules on banner posting are applied according to what is explained in paragraph 6.1.

4.8 The provided service is not only a simple hosting service, every account represents a cell of a big virtual community, for that reason every site must be accessible from the url assigned to it.

4.9 The accounts use shared resources, it is therefore advisable to pay attention to the software used in the own space, because particular heavy or poorly optimized applications cannot be executed in shared environments. To always guarantee an equal distribution of the available resources among the users of every server, AlterVista can arrange the deactivation of some scripts if they are damaging in this sense.


5. Obligations and responsibility of the user

5.1 The user guarantees the originality of every information, program, data ("material") inserted through the service in every form or in every area or space made available by AlterVista.

5.2 The material protected by copyright of others can be used only if the user has obtained, as holder of the author's rights, the related use rights, therefore only with written permission of the right holder and with the obligation to refer to the source and the existence of the permission. The photographic, audio or video material of others or reproducing the images of others can be used only if the user has obtained the permission of the author or of the subject reproduced. With reference to the availability of these rights and permissions, the user assumes every responsibility exonerating completely AlterVista.

5.3 The user assumes also full responsibility about the correctness and truthfulness of the inserted material, in the name and/or for others and assures that it is legitimately available for him or her, it is not against obligatory rules and that is not violating any distinctive sign, intellectual or industrial property right, image right or others rights of other people deriving from rules in force or from customs and uses. However the inserted material must not present pedo-pornographic, pornographic, obscene, blaspheme or defamatory forms and/or contents.


6. Banners

6.1 Displaying banners on the hosted site is optional, except for commercial sites (including but not limited to shops, companies and professionals' websites) or sites promoting any paid service whatsoever, to which the regulations/provisions described in paragraph 6.2 apply.

6.2 Commercial sites, as defined in paragraph 6.1, must display at least one advertising banner on their homepage, unless they registered a second level domain with AlterVista equipped with domain forwarding readdressed to the same site.

6.3 It is forbidden to organize pages exclusively or predominantly dedicated to advertising. Furthermore it is not allowed to insert advertisements on pages under construction, or on pages without any content. Banners must be placed in a visible position and may not be disorderly grouped at the bottom of the page.

6.4 To guarantee the maximum security to the advertisers, the generated advertising traffic is subject to extremely rigorous manual and automatic controls.

6.5 Every attempt to artificially exaggerate advertising revenues, even by repeatedly clicking on one's own advertisements, automatically implies the expulsion of the hosted site from the sponsor's circuits, the suspension of the account, and in the case of repeat offenders, a report to the public authorities.

6.6 The operators managing the circuits and the advertisers can, at their discretion, suspend the participation of the hosted site from one or more advertising campaigns, even if the hosted site produces anomalous statistics. In such cases, the suspension may be ordered by the system, and therefore may be automatically executed.

6.7 It is forbidden to post phrases on the site which may persuade the visitor to click on the advertising banners, even if he or she is not interested in the offer, for example, phrases such as "contribute to the site's maintenance" or "support us".

6.8 Banners must always be displayed in a visible position.

6.9 It is not allowed to display banners, popUps or popUnders, or to use others forms of sponsorship other than those AlterVista provides without the specific written authorization of the staff. Simple banner changes and the links to friend sites are allowed.


7. Remuneration for the advertising on the hosted sites

7.1 The user who decides to display advertising banners on the hosted site has the right to payment of a sum of money earned, determined by referring to the (common) unit tariffs, which are established by consulting the traffic control panel on the hosted site.

7.2 AlterVista is committed to making payment on sums earned, the amount of which its own statistic services determine. The user has the ability to directly verify these numbers on the control panel.

7.3 It is possible to receive payment only after reaching 36.15 Euros, including the 5.16 Euros sign-up bonus credited to each user upon registration. The user has the option to choose the method of payment.

7.4 To ensure that payment can be made correctly, it is necessary to follow the instructions contained in the balance confirmation e-mail, and send the requested documentation.

7.5 Once the balance requested is made through the control panel, the user will have one year's time to communicate to AlterVista the necessary details for the payment, otherwise he or she must pay a penalty based on the obtained credit.


8. Antispam guardianship

The AlterVista community is against spam (generally defined as the sending of not requested and unwished messages to indistinct subjects) practised in every form and with every mean. Users engage therefore to not use community resources for these kind of activities which include for example the sending of messages considered spam and which contained links to one or more AlterVista domains, independently from the fact that the mail server used to send them belongs or not to the AlterVista network.


9. Minor children guardianship

9.1 Minor children must conclude the inscription procedure with the assistance of a parent or legal tutor.

9.2 The subjects who have parental authority over minor children and allow them to use the service are responsible of the online behaviour of their minor children, of the access control and of the consequences in case of service abuses caused by the minor child.


10. Duration and withdrawing

10.1 The service offered is indefinite except the withdrawing of both parts according to the general conditions. However AlterVista reserves the possibility to store all the inactive accounts according to the procedures described in paragraph 10.3.

10.2 An hosted site is considered inactive or abandoned when it is open since more than one month, but it has not received at least one visit which is equal to not less than 10 page views in the last three days, also counting the webmaster's visits on the control panel.

10.3 The recording of an hosted site means the creation of a compressed archive with all its material (eventual mysql database included), placed in an aria in which the webmaster can download it for the following 15 days to the sending of the executed recording notification via e-mail.

10.4 AlterVista preserves the possibility to eliminate the accounts archived for inactivity and which were no more used for the following 6 months in order to reassign the domain to others. The domain reassigning requires the necessary elimination of the previous account.

10.5 The user who is considered a consumer according to the consumer code has the right to freely withdraw the contract within 10 working days after its conclusion. The withdrawing must be executed through a recorded delivery mail (or certified delivery mail) with receiving advice sent to AlterVista, to the registered office placed in Via G. Battista Vico 42‚ 20123 Milano, Italy. The withdrawing can also be sent via e-mail to the address withdrawal@altervista.com, only if the withdrawing communication is confirmed through a recorded delivery mail or certified delivery mail with receiving advice within the following 48 hours.

10.6 The user has the right to withdraw the contract in any time by directly eliminating his or her own account online and without sending any written communication. In this case it is necessary to follow the procedure explained in the FAQs section in the site.

10.7 The elimination of the account ends every kind of contract between the parts.

10.8 In case of withdrawing of the contract, the user can require the balance of the credits obtained with sponsoring if the credit exceeds 36,15 euros as maintained in paragraph 7.3.

10.9 In case of withdrawing of the contract made by AlterVista due to the violation of the general conditions by the user, every expected sum to the user, that is to say the credit obtained, will be kept by AlterVista as a penalty, except the right of AlterVista to a bigger damage.


11. Responsibility limitation

11.1 The user assumes the exclusive responsibility for every activity in the field of the service provided by AlterVista and engages to exclude and to not cause any damaging emerging from any complain, demand or threat related to or deriving from the use or the abuse of the service.

11.2 The user undertakes to use AlterVista exclusively for allowed purposes and pursuant to the law, to rules, uses and customs.

11.3 The user assumes every responsibility for the download operations that he or she executes by using the service and the material to upload in the hosted site.

11.4 The user is responsible and legally punishable in relation with the web space contents available to him or her. While inserting the contents, the user declares to comply with the current Terms of Service.

11.5 If AlterVista is subject to legal actions by others with reference to the activity executed or to the modality of use of the service by the user, he/she accepts to exclude and to not cause any damage to AlterVista from any claim, action or prejudicial effect related to the legal action and he/she undertakes to refund every expense and to compensate for any direct and/or indirect damage suffered by AlterVista owing to these legal actions.

11.6 The user also engages to exclude and to not cause any damage to AlterVista from any responsibility and consequent losses, damages and expenses suffered and/or supported by others and deriving from the use of the hosted site without respecting the obligations contained in the general conditions by the surfers, that is to say by others allowed to use the hosted site, included the eventual legal expenses incurred by AlterVista also with damages hypothesis claimed by others.

11.7 The user assumes every responsibility for every damage or prejudice deriving from him or her or by others from the publication, the removal or the transmission to other unauthorized people of the material inserted by him/her or by others in the hosted site.

11.8 AlterVista declares to not execute any editorial control on the contents of the hosted sites. Therefore every responsibility for damages and illicit actions deriving from these contents are exclusively attributable to the users.


12. Changes in the service or in the general conditions (Terms of Service)

12.1 AlterVista reserves the right to modify in any time the general conditions (Terms of Service) and the term and features of the service offered, by publishing on the site general advices to the users or by an e-mail to the user with the indication of the efficiency date of the changes. This data must be subsequent to at least 30 days referring to that of the AlterVista communication.

12.2 If the changes determine a considerable reduction of the service, the user has the right to withdraw the contract within 15 days from the receiving of the variation communication.

12.3 The continued use of the AlterVista service after the deadline reported in paragraph 12.1 represents the will to accept the general conditions (Terms of Service).

12.4 Except what reported in paragraph 12.3 if the user communicates to AlterVista the wish to not accept the modifications of the general conditions, the contract will be cancelled for the effect of the withdrawing of AlterVista, which will be effective 30 days after the communication reported in the paragraph.

12.5 The general conditions (Terms of Service) will be valid even if AlterVista changes its domain and/or its company name and/or is interested in extraordinary operations with an other company or society.


13. Service suspension

13.1 AlterVista reserves the right to temporary suspend, without any preventive communication, the supply of the service for the time strictly advisable for necessary and /or appropriate technical actions to improve the service quality.

13.2 AlterVista has the right to interrupt in every moment the performance of the service for security reasons or secrecy violations, by communicating them to the user.

13.3 AlterVista also reserves the right to immediately and permanently interrupt the supply of the service to the user who, after verification, has violated the dispositions related to his or her obligations.


14. Applicable law

14.1 These terms and conditions shall be governed by and construed in accordance with Italian law.

14.2 Any dispute, controversy or claim arising out of or in connection with these terms and conditions, in case the User is a Consumer, shall be settled by the competent court having jurisdiction over the place indicated by the User as his residence or domicile at the time of the registration (or subsequently modified), if located within the Italian territory.


15. Rules applicable to the amusement areas or the Forum

15.1 The users who use the AlterVista forum are subject to the dispositions described in the general conditions (Terms of Service).

15.2 Forum users must respect the following rules.


Forum rules

A). Considering what is described in the general conditions (Terms of Service), the user must respect the "netiquette" (literally the etiquette of the net) and its eventual modifications and integration in which there are various limitations to the behaviours that net users have to observe while using it and that are reported in the version currently published on the Italian Naming Authority site.

  1. When it is activated in a new newsgroup or in a distribution list via mail, it is advisable to read the present messages at least for two weeks before to send own messages over the world: in this way people are more informed about the topic and the way it is threaded in that community.
  2. The messages to be sent have to be short and must clearly describe the problem. It is advisable to always specify, in a short but meaningful way, the object (field "subject") of the mail text. If a "signature file" is used, it must be short and meaningful.
  3. Do not digress on the newsgroup or distribution list topic via mail.
  4. Avoid the broadcasting of the own message towards many mailing lists ( or newsgroups). In most cases there is one mailing list which represents the correct addressee and which includes only the users really interested in.
  5. While answering to a message, it is advisable to highlight the most relevant passages in the original message with the aim to render the understanding easier for those who have not red the message. Do not report the whole message if it is not necessary.
  6. Do not conduct "opinion wars" on the net by writing a lot of messages. If there are personal diatribes, it is better to resolve them privately between the parts via e-mail.
  7. Do not publish mail content without author's permission.
  8. Do not publish stupid messages or that simply take the side of one competitor in the discussion. It is advisable to always read the FAQs ( Frequently Asked Questions) on the discussed topic before to send new questions.
  9. Do not send advertising messages via e-mail or any communication, unless they have been explicitly required.
  10. 1.Do not be intolerant to people who make syntactical or grammar mistakes. However writers have to improve their language and render it comprehensible to the community.


To the previous rules are added some criteria which derive from the common sense:
  1. The net is used as a working tool by many users. None of them has the time to read useless, frivolous and private messages, and therefore not considered of general interest.
  2. Every activity considered heavy for the traffic or the net services such as the transfer of extensive archives or the sending of mails with big attached documents to many addressees, gradually lapses the total rendering of the net. We recommend you to execute these operations trying to reduce as much as possible the impact on the net. In particular we recommend to:
    • Execute archive transfers during different times to those of maximum traffic (for example during the night) taking into account differences among time zones.
    • Do not send via mail huge quantities of data and specify, if it is possible, the URL location of the message, maintaining them available for the accessing and the consulting in the net.
  3. On the net there are several sin servers (file servers) which contain in an updated copy, the documentation, the software and other available objects on the net. It is advisable to previously be informed about which server is the most accessible for you. If a file is available on it or locally, there is no reason to take it from the net by occupying unnecessarily the line and spending more time for the transfer.
  4. The software available on the net can be covered by a patent and/or by various use restrictions. Always read the accompanying document carefully before to use, modify or redistribute it in any form or way.
  5. Totally improper behaviours by the user, such as:
    • violating archives and computers security in the net
    • violating the privacy of other net users, by reading or intercepting the mails addressed to them
    • compromise the functioning of the net and of the devices which constitute it with programs (viruses, Trojan horses, etc.) created for these purposes.
    • They are defined as electronic crimes and therefore are punishable by the law.

B). Forum moderators are not subjected to the AlterVista management control and assume spontaneously the task of monitoring the discussions. Therefore AlterVista cannot assure their steady presence and declines every responsibility for their activity.

The moderator group is an open group, everyone can become a part of it; it is composed by users who voluntary want to maintain the order in the forum. To guarantee a proper functioning of the forum, moderators shall apply themselves to do their work with the maximum seriousness and equity, as well as users shall apply themselves to make the moderation activity possible by respecting moderators and their decisions.

C). For every support forum there are some tag instructions to use in titles.

D). It is advisable to conduct a research before starting a discussion.

E). Users and moderators are not obliged to answer to the questions asked in the Forum.

F). Spam, crossposting, UT and OT activities are not allowed.

G). Every user can be "banned", that is to say loosing the right to write on the forum for the whole duration of the ban, with any own account. In case of use of other accounts, they will be banned too for the same or higher duration compared to the main sanction. The decision to ban a user is taken by moderators.

H). Moderator decisions are final and unchallengeable. It is not allowed to start discussions on the forum to request explanations about the measures taken. For every explanation is possible to use private forms ( for example, e-mails and private messages).

I). For all the prohibitions above described, in order to simplify the moderation and control activity of the warnings received done by users, a point system has been introduced. When a user has received a warning, the violation will be notified, as well as the violation score and the score expiration date. To the achievement of some score thresholds, the forum ban will start automatically.

  • Insultes/Coarse language: 10 points - 6 months
  • Private discussions in public: 10 points - 5 months
  • Spam/cross posting: 10 points - 6 months
  • Up/consecutive posts: 5 points - 3 months
  • Search not executed: 5 points - 1 month
  • Old topic recover: 5 points - 1 month
  • Title not explicit: 5 points - 1 month
  • Too long signature: 5 points - 1 month
  • Presence with other nick, if banned: 50 points - no expiration
Score thresholds:
  • 20 points 3 days of ban
  • 25 points 7 days of ban
  • 30 points 1 month of ban
  • 35 points 3 months of ban
  • 50 point fixed ban

L). In order to maintain the forum as "clean" as possible for a clear and easy surfing and consulting to the move of the message staff in appropriate areas, a redirect will be left towards moved discussion. This redirect is valid for a week, after this time it will not be usable and visible anymore (only the redirect).




16. Special terms and conditions applicable ONLY to who requires a second level domain registration ("Domain registration service").

The users who make use of the Domain Registration Service, are subject to the dispositions present in the general conditions. According to the general dispositions, those related to the service are extended also to the domain registration service, except if is not differently specified. The users of the domain registration service have to respect these terms and conditions.

16.1 The domain registration service allow the registration of a own second level domain (for example, yourname.com, org, net, info), with the additional possibility to make use of some other services ("Accessory services") as it is in detail explained in the site. The registration of a domain do not imply the creation of a new web space or any modifications to the existent one or to the associated virtual host.

16.2 The supply and the updated features of the domain registration service and of the accessory services can be consulted on the site in the section FAQs: http://it.altervista.org/faq_domini.php

16.3 The user who decides to pay for using the domain registration service and the accessory services, can choose the payment modality within those presented in the control panel. The payment can be executed by deducting the sum of the earnings obtained by the own account, if the user has obtained a sufficient amount to request the balance according to the paragraph 7.3 and for the purchase of the selected domain registration service.

16.4 The user is informed about the fact that the registration of a .biz domain is reserved to people who want to make a proper use for a commercial activity, based on the exchange of goods and services.

16.5 AlterVista goes on with the name registration in the domains following the chronological order of the requests and it does not assume any responsibility on the acceptance of the registrations by the relevant registration authorities, neither for the disputes on the domain name assigning or for eventual modifications in the registration procedures or in the naming rules by the registration authorities.

16.6 AlterVista apply itself to maintain an efficient and functional domain registration service. AlterVista declines every responsibility on direct and indirect damages caused by the service, taking however into account that in case of a missed removal of the registration caused by AlterVista, the company will pay a fine in favour of the user equal to three times as much as the sum paid by the user for the renewal request of the domain name, except any other claim or compensation by the user.

16.7 The user must control in the registers of the relevant registration authorities that the registration procedures have been properly executed.

16.8 The domain registration service lasts one year starting from the effective registration of the domain name. After this year the domain registration service will be interrupted, unless it is renewed at least 30 days before the expiration date by the payment of the sum referred to the current tariffs at the moment of the renewal.

16.9 The user is informed about the fact that he/she has the duty to be informed about the current rules for the solving of the disputes on domain names (Uniform Domain Name Dispute Resolution Policy) with reference to the required domain registration service.

16.10 AlterVista reserves the right to modify the domain registration service and the service conditions in any time according to the modalities established by the article 12 of the general conditions. However for every active contract the conditions present at the moment of the conclusion of the contract will be granted, until the contract annual expiry date.

16.11 In case of domain transferring to an other provider or maintainer made by the user, the contract will be ended due to the withdrawal of the user starting from the date from the transferring conclusion with the following deactivation of all executed accessory services. AlterVista will maintain the sum already paid and referred to the residual duration of the contract as the amount due for the withdrawing.

16.12 AlterVista reserves the right to suspend the domain registration service and the accessory services in cases of disputes with others about the registered domain name, waiting for the conclusion of the dispute and excluding any repayment or compensation and the direct responsibility of AlterVista for the misuse of the domain registration service and the accessory services by the user during the suspension time.
